A litigator is not always the type of attorney you see on television drama shows. A litigator’s work often begins with investigating the facts, drafting responsive pleadings, and engaging in a process called “discovery” whereby attorneys are duty-bound to exchange information. If a matter does not settle informally, then the litigator may go to mediation or other alternative dispute resolution procedures. If formal settlement negotiations do not resolve the matter, then the litigator may have to prepare for trial.
